Abstract
The issue of illegal immigrants remains a problem both in Indonesia and internationally. Indonesia as a strategic country with archipelagic territory becomes a place for illegal immigrants. Illegal immigrants are people who enter or stay in a country illegally. The problem of illegal immigrants has become the domain of global issues given international and national legal instruments to provide protection against illegal immigrants. In the global issue, Indonesia is not a party that signed the 1951 Convention on Refugee status and the 1967 Protocol. The human rights framework available in Indonesia is regulated in Law No. 39 of 1999 on Human Rights. Human rights describes certain standards of human behavior in order to obtain protection of basic human rights. The protection of illegal immigrants is necessary to fulfill the basic human rights standards wherever they are.
